A Federal High Court Dismissed Busola Dakolo's Suit And Fined Her 1 Million Naira

A Federal High Court Dismisses Busola Dakolo's suit and fines her 1 million. The court considered her suit frivolous and aiming to cause injury

In the news yesterday, Busola Dakolo's Suit was dismissed by a federal high court and she was fined 1 million Naira. This wasn't the first case of a sexual assault allegation against the Pastor, but the most high profile. It also opened a can of worms as many other alleged victims of the Pastor stepped forward.

In an interview with Chude Jideonwo, Busola explained that while she was a member of the church, the pastor raped her twice. Accordingly, the matter went before a court, but unfortunately, the Federal Capital Territory High Court dismissed the suit filed by Bukola Dakolo and ordered her to pay 1 million for wasting the court's time.

Her lawyers, Pelumi Olajengbesi and Co of Law corridor, filed the suit on her behalf. In the suit, she asked the court to declare that Fatoyinbo's denial through a statement he released on June 28, 2019, had caused her emotional pain. As a result, it was a move to add to her pain.

However, Fatoyinbo’s lawyer, Alex Iziyon (SAN), described it as a frivolous suit that could not be granted. In his statement, pastor Fatoyinbo declared that he has never raped anyone before. Afterwards, he asked for the court to dismiss the suit filed by Dakolo, demanding for the sum of fifty million for damages through his lawyers.

According to the PUNCH, Justice Oathman Musa, in his ruling on Thursday held that the matter amounts to injustice and an abuse of judicial process adding that the case is empty and purely sentimental. Justice Musa further said that the case aimed more at cruelty than obtaining justice.

Busola Dakolo released a two-part statement on Instagram:

The substance of the suit which is my allegations of sexual abuse leading to emotional distress on my person against Mr. Biodun Fatoyinbo has neither been entertained by the court nor ruled upon. I believe that the effect of the injurious claim is a continuous one that transcends time and place.
This has only made me to wonder more what a country we have? I was particularly surprised at the hearing of the case when the court said the file was missing and later when the court said my own processes cannot be found and finally the case is out of time. This only shows that we have a lot to address to bring sanity to our country.
Today, I am glad that my voice is not silenced and this is victory for me. I must encourage every woman out there to keep the pace and never stop voicing out against the evil of rape and sexual abuse. Do not be dispirited by today’s court decision.
No judgement has been made declaring the innocence of Mr. Biodun Fatoyinbo. It must be stated that while our experience has a shared theme, the circumstances are different. We must not give up for our victory lies more in finding our voice than anything else.

Further Reports On The Case

Her lawyers report that mishaps happened in the filing process like their files being lost mysteriously. For Busola, victory was not securing judicial victory but by boldly sharing her story.  The move to call out her abuser empowered other women to speak out.
